Can I Change From H-1B to B-2 After a Layoff?

Updated 2026-10-214 min readNot legal advice inWX
QUICK ANSWER

Yes. You can file Form I-539 to change from H-1B to B-2 visitor status before your grace period ends. A timely filing lets you stay while USCIS decides, but you cannot work.

How the B-2 change works

You file Form I-539, Application to Extend/Change Nonimmigrant Status. Family members in H-4 status are usually added as co-applicants on Form I-539A.

The filing fee is $470 on paper or $420 online, under the USCIS fee rule in 8 CFR 106.2. USCIS may also schedule a biometrics appointment.

Premium processing is not offered for a change to B-2. It is only available on Form I-539 for students and exchange visitors, so expect a wait of months. Check the USCIS processing times tool for current numbers.

USCIS has said a timely, nonfrivolous change of status filing stops unlawful presence from building while it is pending. That holds only if you kept your status and did not work without permission. If the request is denied, unlawful presence starts the next day.

Timeline: filing inside the 60 days

Your grace period is up to 60 days or until your I-94 ends, whichever comes first. The full rules are in our 60-day grace period guide.

  1. Day 1: the grace period starts the day after your last day of employment. Get that date in writing from HR.
  2. Days 1 to 7: check your I-94 end date on the CBP website. Collect your termination letter, last pay stubs and I-797 approvals.
  3. Days 7 to 30: decide on a plan. If a new H-1B offer looks unlikely soon, prepare the B-2 filing with real visitor plans and proof of funds.
  4. Before day 60 or the I-94 end date: USCIS must receive the I-539. Late filings can be refused.
  5. After filing: keep the receipt notice, stay in the US and do not work.

What changed in 2026

USCIS has archived its old page on options after a job ends. That page said job searching and interviewing were allowed in B-1 or B-2 status. It now carries an out-of-date notice.

Duane Morris reported in May 2026 that USCIS now treats an open-ended job search as inconsistent with a temporary visit for pleasure. Requests for a full 180 days have drawn particular skepticism.

Fennemore described this in July 2026 as an adjudication trend, not a change to the regulation. Requests for evidence often ask about three things: your visitor activities, how you will support yourself without working, and your plan to leave.

USCIS has also used a later H-1B petition as evidence that the visitor purpose was not genuine. Lawyers call this the intent trap.

What you can and cannot do on B-2

  • You can travel inside the US, visit family, get medical care and wrap up personal affairs.
  • You cannot work in any form, including freelance or paid remote work.
  • You cannot start a full-time degree program without a change to student status.
  • Do not describe job hunting as the main reason for your stay. Ask a lawyer how to handle interviews.

A new H-1B while the B-2 is pending

A new employer can still file an H-1B petition that asks to change your status from B-2. The catch is the start date.

H-1B portability, which lets you start work when the petition is filed, generally covers people moving from H-1B status. Law firms advise that it does not cover someone in B-2 or with a B-2 change pending. You usually wait for approval and the start date on the approval notice.

USCIS generally needs a valid status to change from. If the B-2 request is denied, Duane Morris notes the H-1B can only be approved for consular notification. You would then leave the US, get a visa stamp and return.

Fennemore warns that premium processing the H-1B can pull the pending B-2 into immediate review. If your approved B-2 period may end before the H-1B is decided, ask a lawyer about an extension before it ends.

Travel risk and the $100,000 fee

Leaving the US while your I-539 is pending generally abandons it. A new H-1B petition would then need a visa stamp abroad.

USCIS guidance says the $100,000 payment can apply when a change of status is denied or the petition asks for consular notification. As of October 21, 2026, court orders block collection, but USCIS says it plans to collect if the orders are lifted. See our $100,000 fee guide.

If you build up more than 180 days of unlawful presence and then leave, you can face a 3-year bar on returning. One year or more can bring a 10-year bar. If your B-2 is denied, leave promptly.

The proposal to end the grace period

On September 11, 2026, DHS proposed removing the 60-day grace period at 91 FR 57807 (docket USCIS-2026-0364). Comments close November 10, 2026.

Under the proposal, H-1B workers and their dependents would fall out of status the day after employment ends. That could leave no window to file a B-2 change. It is not final as of October 21, 2026.

DHS data in the proposal show about 1.7% of workers who lost or changed jobs from 2021 to 2025 filed an I-539 during the grace period.

Options to compare first

B-2 is one option, not the default. If your spouse holds H-1B, H-4 may be stronger; see H-4 EAD. If you want to study, read H-1B to F-1.

The cleanest path is usually a fast new H-1B petition filed inside the grace period. Our 60-day job search plan covers how to get there. Canadians, Mexicans and Australians can also look at TN and E-3.

This is general information, not legal advice. Confirm your situation with an immigration attorney.

Questions

How long does an H-1B to B-2 change take?

USCIS does not offer premium processing for a change to B-2, so decisions often take months. Check the USCIS processing times tool for Form I-539.

Can I start a new H-1B job while my B-2 is pending?

Usually not on the receipt notice. Law firms advise that portability does not cover people in B-2, so you wait for the H-1B approval and its start date.

Can I go to job interviews in B-2 status?

USCIS has archived its old statement that job searching was allowed in B status. Since 2026 it treats an open-ended job search as inconsistent with a B-2 visit, so get legal advice first.

What happens if my B-2 change is denied?

Unlawful presence generally starts the day after the denial. A pending H-1B can then only be approved for consular processing, so plan to leave promptly.

Does my H-4 spouse need to file too?

Yes. Family members in H-4 status are usually added as co-applicants on Form I-539A with your I-539.

Is the 60-day grace period being removed?

DHS proposed removing it on September 11, 2026, with comments due November 10, 2026. As of October 21, 2026, it is a proposal, not a final rule.
