H-4 EAD: Who Qualifies and How to Apply

Updated 2026-10-215 min readNot legal advice inWX
QUICK ANSWER

An H-4 spouse can get a work permit if the H-1B spouse has an approved I-140 or an AC21 extension. The AC21 extension here means H-1B time granted under sections 106(a) and (b) of that law. H-4 status alone does not allow work.

Find jobs you can take on H-4 EAD

Every job is from an employer that filed H1Bs in 2025. See which ones fit your resume.

Who qualifies

You must be in H-4 status as the spouse of someone in H-1B status. Then the H-1B spouse must meet one of two conditions.

  • The H-1B spouse is the principal beneficiary of an approved Form I-140.
  • The H-1B spouse's stay was extended under AC21 sections 106(a) and (b). This is the extension past six years based on a PERM or I-140 filed at least 365 days earlier.

How to apply

File Form I-765, Application for Employment Authorization. Use the newest edition of the form.

The eligibility category for this EAD is (c)(26). USCIS rejects filings without the proper fee or signature, so check the current I-765 instructions.

  1. Proof of your current H-4 status
  2. A photo ID
  3. Proof of marriage
  4. Proof that your spouse has an approved I-140 or an AC21 106(a) and (b) extension
  5. Proof that your spouse is in H-1B status
  6. Two passport-style photos
  7. Certified English translations of any foreign-language documents

Filing with your spouse's extension

You can file the I-765 alone, with your I-539 H-4 extension, or with both the I-539 and your spouse's I-129.

USCIS will not decide the I-765 until it decides the I-539. Filing location depends on which forms go together.

If you are filing it with an I-485, use category (c)(9) instead, not (c)(26). You then pay the I-485 filing fee.

Filing online and fees

USCIS lets you file many Form I-765 categories online through a free USCIS account. When you start the form, the system shows whether your category can be filed online. If not, file on paper.

Under the 2024 USCIS fee rule, the I-765 fee for most categories is $470 online or $520 on paper. Fees change, so check the USCIS fee schedule before you pay.

There is no premium processing for the H-4 EAD or for a dependent's Form I-539. If you bundle with your spouse's petition, ask the employer's attorney how they file.

How long the EAD lasts

Your EAD end date should match the end date on your most recent H-4 Form I-94.

You cannot file a renewal more than 180 days before your current EAD expires.

Processing times

Processing times change month to month and differ by service center. Check the USCIS processing times tool for Form I-765 before you plan around a date.

Law firm reports from 2026 range from a few months to more than a year. Standalone filings have often taken longer than filings bundled with the H-1B spouse's petition.

Bundling is no longer a guarantee. The Edakunni settlement, which required USCIS to decide bundled H-4 filings together, expired in January 2025.

Automatic extensions have changed

This is the change most H-4 families need to know about.

For renewals filed before October 30, 2025, eligible H-4 spouses could get an automatic extension of up to 540 days, capped by the H-4 I-94 end date.

A DHS interim final rule ended automatic extensions for renewals filed on or after October 30, 2025. That includes H-4 EADs in category (c)(26). Extensions already in effect before that date were not cut short.

If your card expires while the renewal is pending, you must stop working on the expiration date and wait for the new card.

H-4 spouses sued over the rule in January 2026. As of October 2026, no court order has restored automatic extensions. File your renewal as early as the 180-day window allows.

Keeping your EAD valid

The rules also require that your spouse is currently in H-1B status and you are in H-4 status. If either status ends, eligibility ends too.

Keep your H-4 extensions in step with your spouse's H-1B extensions. Filing them together is often simplest.

If your spouse changes employers, the H-4 EAD can still rest on an approved I-140. An I-140 approved 180 days or more is not automatically revoked when the old employer withdraws it.

Track three dates on a calendar: your spouse's H-1B end date, your I-94 end date, and your EAD end date.

If your H-1B spouse is laid off

After a job loss, your spouse and you may get a grace period of up to 60 days, or until the I-94 ends if sooner. USCIS calls it discretionary.

USCIS says a spouse's work authorization stays valid during that grace period. You can keep working on your H-4 EAD while your spouse looks for options.

If a new H-1B employer files for your spouse in time, your H-4 can continue with it. Your EAD can still rest on the approved I-140. If your spouse changes to another status or leaves, your H-4 status and EAD end. See the 60-day grace period guide.

Laid off yourself? Switching to H-4

If you lose your own H-1B job and your spouse holds H-1B, you can ask to change to H-4. File Form I-539 during your grace period. USCIS lists this as an option after a job loss.

You can keep job hunting while it is pending. A pending application does not let you work. On H-4, you can work only with an H-4 EAD, and only if your spouse meets the I-140 or AC21 rule.

When a new employer files an H-1B petition for you, it can ask to change you back to H-1B. If you were counted against the cap before, you usually do not need a new lottery.

Job hunting on an H-4 EAD

An H-4 EAD is not tied to one employer. You can generally work for any employer, full-time or part-time, or be self-employed. The employer does not need to file a visa petition for you.

Say up front that you have your own work permit. You show the EAD card for the Form I-9. If an application asks whether you will need sponsorship later, answer honestly.

Your EAD depends on your spouse's status and green card progress. If your spouse's employer cannot file PERM, your path to the EAD may stall too. As of October 2026, PERM filings are frozen at eight employers, including Microsoft, Infosys and TCS.

If you may want your own H-1B later, focus on employers with a sponsorship record. Browse H1B jobs by role or match sponsor jobs to your resume.

Questions

Can I work on H-4 without an EAD?

No. USCIS says you must receive the EAD before you begin working.

Does the I-140 have to be from my spouse's current employer?

The rule only requires that your spouse be the principal beneficiary of an approved I-140. Confirm your facts with an attorney.

When can I file my H-4 EAD renewal?

No more than 180 days before your current EAD expires.

Will my H-4 EAD be automatically extended while renewal is pending?

For renewals filed on or after October 30, 2025, most applicants are not eligible, per USCIS's employer handbook.

What happens to my H-4 EAD if my H-1B spouse is laid off?

USCIS says your work authorization stays valid during your spouse's grace period of up to 60 days. If your spouse does not move to a new H-1B employer or another qualifying status in time, your H-4 status and EAD end.

How long does H-4 EAD processing take in 2026?

It varies by service center and changes monthly, so check the USCIS processing times tool. 2026 law firm reports range from a few months to more than a year, and there is no premium processing for the H-4 EAD.

Can I switch from H-1B to H-4 after a layoff?

Yes, if your spouse holds H-1B status, you can file Form I-539 during your grace period. You can keep job hunting, but you cannot work until you have an H-4 EAD or a new H-1B takes effect.

Do I need sponsorship to work on an H-4 EAD?

No. While your EAD is valid, you can work for any employer without a visa petition. You would need sponsorship only to get your own work visa later.
