H-1B Visa Stamping and Travel in 2026: What to Know

Updated 2026-10-214 min readNot legal advice inWX
QUICK ANSWER

You can still travel abroad on H-1B in 2026, but most people now need an in-person interview to get a new visa stamp. Several rules changed in 2025 and 2026.

Find H-1B sponsor jobs for your role

Every job is from an employer that filed H1Bs in 2025. See which ones fit your resume.

Do you need a new visa stamp?

To come back from a trip, you generally need a valid H-1B visa stamp in your passport. An I-797 approval notice usually does not allow reentry by itself.

If your stamp is still valid, you may not need a new one after changing jobs. CBP looks at your current approved petition, not the employer name on the stamp.

Entry is always up to the CBP officer. Check your I-94 record right after you arrive.

Interview waivers mostly ended in 2025

The State Department's current interview policy took effect on October 1, 2025. Nearly all nonimmigrant visa applicants now need an in-person interview.

H-1B renewals are not on the exception list. The exceptions are mainly diplomatic and official visas, some B-1/B-2 renewals and H-2A renewals.

Even when a waiver applies, a consular officer can still ask you to come in.

Where you can apply

Since September 6, 2025, the State Department has told applicants to apply in their country of nationality or residence.

If you apply in a country where you live but are not a citizen, be ready to prove your residence there.

Applying somewhere else is not formally banned. But the State Department warned it may be harder to qualify, and visa fees are not refundable or transferable.

Social media review and delays

From December 15, 2025, the State Department extended its online presence review to H-1B and H-4 applicants.

Applicants were told to set all social media profiles to public.

In December 2025, posts in India moved many H-1B interviews by several months. Some were pushed into spring 2026.

Check wait times at your consulate before you book flights. Have a backup plan if your interview moves.

How to prepare for the interview

H-1B interviews are usually short. The officer checks that the job is real and that you match the approved petition.

  1. Know your job title, duties, salary, work location and end client, if any.
  2. Answer briefly and truthfully. If you do not know something, say so.
  3. Bring your passport, DS-160 confirmation, I-797, an employment letter, recent pay stubs and degree certificates.
  4. If you work at a client site, bring the client letter or project details your employer provides.

If you get a 221(g) refusal

A 221(g) refusal means the consulate needs more documents or checks before it decides. It is not a final denial.

Administrative processing can take weeks or longer. You cannot return on a new visa until it clears, so plan for delays.

Traveling while a transfer or extension is pending

A pending petition is the riskiest time to travel. Law firms generally advise waiting until your new employer's petition is approved.

If you leave while a change of employer or extension is pending, USCIS generally treats the request to extend your stay as abandoned. It can still approve the petition itself, and you then come back on that approval.

To return, you need a valid H-1B visa stamp. It does not have to name your new employer. Carry your new I-797 approval notice.

Coming back before approval, on an old visa and a receipt notice, is riskier. Ask your new employer's lawyer first.

There is also a fee risk, explained below. Read our H-1B transfer guide before you plan a trip during a job change.

The $100,000 proclamation and travel

A September 19, 2025 proclamation required a $100,000 payment for certain new H-1B petitions.

It targets petitions for workers outside the US who do not have a valid H-1B visa.

USCIS says it does not stop current H-1B visa holders from traveling in and out of the US.

It also does not apply to an amendment, change of status or extension that USCIS grants inside the US. But if you leave before USCIS decides, the payment can apply.

On June 8, 2026, a federal court in Massachusetts vacated USCIS's guidance on the payment. On July 24, 2026, the appeals court refused to pause that ruling.

On September 18, 2026, a new proclamation extended the requirement through September 21, 2027.

As of October 2026, collection is paused by the court order, but the appeal is pending. See our $100,000 fee guide for updates.

E-3 for Australians: process and timing

The E-3 is a separate work visa for Australian citizens in specialty occupations. It works much like H-1B but has no lottery. Up to 10,500 are available each year.

The employer first files a Labor Condition Application with DOL, which DOL generally decides within seven working days. You then complete the DS-160 and interview at a US consulate. No USCIS petition is needed for that route.

If you are already in the US, the employer can file Form I-129 with USCIS to change or extend your status instead.

E-3 status lasts up to two years at a time, with no limit on extensions. Spouses are authorized to work.

Total time depends mostly on interview waits. Law firms commonly estimate a few weeks to about three months. The same in-person interview and country-of-residence rules apply.

Before you book a trip

  • Check the expiry dates on your visa stamp and passport.
  • Confirm your petition is approved, not just pending.
  • Look up interview wait times in your country of nationality or residence.
  • Set your social media profiles to public if you need a new stamp.
  • Carry your visa, your latest I-797, an employment letter and a copy of your petition.

This is general information, not legal advice, so confirm your situation with an immigration attorney.

Questions

Can I renew my H-1B stamp without an interview in 2026?

Generally no. Since October 1, 2025, most nonimmigrant visa applicants need an in-person interview, and H-1B renewals are not on the exception list.

Can I apply for my H-1B visa in a third country?

The State Department says to apply in your country of nationality or residence. Applying elsewhere may make it harder to qualify, and fees are not refundable.

Do I owe the $100,000 payment if I travel on a valid H-1B visa?

No. USCIS says the proclamation does not stop current H-1B visa holders from traveling. As of October 2026, collection is also paused by a court order.

Should I travel while my H-1B transfer is pending?

Most law firms advise waiting for approval. Leaving before USCIS decides a change of status, amendment or extension can create status and fee problems.

Can I travel while my H-1B transfer is pending?

You can, but it is risky. Leaving generally abandons the request to extend your stay, so you return on the approved petition with a valid visa stamp, and an early departure can also trigger the $100,000 payment question.

Does my H-1B visa stamp need to show my new employer?

No. If the stamp is still valid, CBP looks at your current approved petition. Carry your new I-797.

What is a 221(g) refusal?

It means the consulate needs more documents or checks before deciding. It is not a final denial, but you cannot travel on a new visa until it is resolved.

How long does an E-3 visa take?

DOL generally decides the LCA within seven working days, then you wait for a consular interview. Law firms commonly estimate a few weeks to about three months in total.
