Day 1 CPT: How It Works and Risks for Future Visas

Updated 2026-10-214 min readNot legal advice inWX
QUICK ANSWER

Day 1 CPT is curricular practical training that a graduate program allows from the first term. It is legal only when the program truly requires the training of every student. As of October 2026 it still exists, but under stricter SEVP guidance from August 2026 that is now being challenged in court.

How CPT works

CPT is work authorization tied to your curriculum. ICE says it must be integral to your major and part of your program of study.

  • Your DSO authorizes CPT in SEVIS. USCIS is not involved, unlike OPT.
  • Authorization covers one specific employer for a specific period.
  • You cannot start before the CPT start date on your Form I-20.
  • CPT can be part-time or full-time.
  • Twelve months or more of full-time CPT ends your eligibility for OPT. Part-time CPT does not.

Where "Day 1" comes from

Normally, you must be enrolled full-time for at least one academic year before CPT.

Study in the States notes an exception for graduate students whose programs require earlier training. Day 1 CPT programs rely on that exception.

A partner at Fragomen co-wrote that the F-1 rules permit this for programs that require immediate CPT. The same article says there is no such thing as a "day 1 CPT university."

What changed in August 2026

SEVP sent broadcast messages to school officials on Aug. 12 and Aug. 24, 2026, according to Boston University.

The messages define "integral" more strictly. CPT must be essential to degree completion for all students in the program. It cannot be authorized solely for employment.

The CPT regulation itself did not change. The guidance narrows when schools can authorize CPT. Boston University paused some approvals while it reviews its programs.

On Oct. 5, 2026, higher education groups, including NAFSA and the Association of American Universities, sued over the guidance. MIT reports the guidance remains in effect while the case is pending.

As of October 2026, ask your school how it is applying this guidance before you enroll or renew CPT.

Risks for future visas

  • H-1B and green card review: the Fragomen co-authored article warns these actions could be questioned when you apply for future benefits.
  • Program scrutiny: Murthy Law Firm notes Day 1 CPT gets a great deal of USCIS scrutiny. Some schools failed to follow the rules, causing major problems for their students.
  • Visa stamping abroad: Murthy says travel is allowed, but getting a visa stamp may be risky depending on circumstances.
  • Losing OPT: a year of full-time CPT removes OPT eligibility. That also removes the STEM OPT path and cap-gap work time.
  • Primary purpose: you must be a full-time student first. A program built mainly around work authorization is the core concern.

Green card questions

In a green card case filed inside the US, USCIS checks whether you kept lawful status and worked only with permission.

For EB-1, EB-2 and EB-3 cases, section 245(k) forgives up to 180 days in total of status violations or unauthorized work. It looks only at time after your most recent lawful admission. Dependents can use it in their own right.

245(k) does not cure other grounds, such as a finding of willful misrepresentation. Spouses of U.S. citizens are generally not barred by past status violations, but fraud findings still matter.

If your spouse's job is the basis of the case, your own F-1 history can still come up in your I-485. Keep transcripts, attendance and CPT records.

Travel and visa stamping

CPT does not stop you from traveling. To return as a student, you need a valid F-1 visa and a Form I-20 with a recent DSO travel signature.

The risk is the visa interview. A consular officer decides whether you are a genuine student. Since September 2025, most F and H applicants must interview in person, generally in their home country.

Your F-1 history can come up again at a later H-1B stamping. See visa stamping and travel.

F-2 spouse and children

F-2 dependents keep status only while you keep F-1 status. If your status ends, theirs ends too.

F-2 dependents may not work. An F-2 spouse may study only part-time at an SEVP-certified school, or take recreational classes. F-2 children may attend kindergarten through 12th grade.

If your spouse wants to study full-time, they need their own F-1 status.

If you lose your CPT job

CPT is authorized for one employer and one period. If that job ends, tell your DSO right away.

Your F-1 status rests on full-time enrollment, not the job. The 90-day unemployment limit applies to OPT, not CPT. You must still attend and meet every program requirement, including required training.

You need a new CPT authorization in SEVIS before you start with a new employer.

How to lower the risk

  1. Confirm the school is SEVP-certified and properly accredited.
  2. Get the written curriculum showing the training is required for every student in the program.
  3. Attend classes and keep transcripts, attendance and coursework records.
  4. Make sure each job matches your major and the employer on your I-20.
  5. Talk to an immigration attorney before enrolling, and again before an H-1B filing or travel.

Questions to ask a school before you enroll

  • Is the practical training required for every student in this program, or optional?
  • How has the school applied the August 2026 SEVP guidance?
  • How often do classes meet, and how is attendance recorded?
  • Will the CPT appear as concurrent academic registration on my transcript?
  • Does the school track how its graduates fare with later H-1B filings?

Alternatives worth comparing

If your goal is H-1B, the standard path is often simpler. It runs through post-completion OPT, a possible STEM OPT extension, and cap-gap.

Employers that have filed H-1B before are a good place to start. See /h1b-sponsors and current roles at /h1b-jobs.

Questions

Is Day 1 CPT legal?

F-1 rules allow CPT before one academic year for graduate programs that require earlier training. It must be a real, required part of the curriculum.

Did Day 1 CPT end in 2026?

The regulation did not change. As of October 2026, SEVP guidance from August 2026 narrowed what counts as integral, and some schools paused approvals.

Can Day 1 CPT affect my H-1B?

It can draw questions. Immigration attorneys warn it may be examined when you apply for H-1B or a green card.

Does CPT use up my OPT?

Only full-time CPT of 12 months or more. Part-time CPT does not affect OPT eligibility.

Does Day 1 CPT still work in 2026?

It still exists, but August 2026 SEVP guidance limits CPT to training that every student in the program must complete. Higher education groups sued on Oct. 5, 2026, and the guidance stays in effect while the case is pending.

Can Day 1 CPT affect my green card?

It can be reviewed. For EB-1, EB-2 and EB-3 cases, section 245(k) forgives up to 180 days of status violations or unauthorized work after your last lawful admission, but it does not cure findings such as misrepresentation.

Can my F-2 spouse work while I am on Day 1 CPT?

No. F-2 dependents may not work, and their status depends on yours.

What happens if I am laid off while on Day 1 CPT?

That CPT authorization ends with the job, but your F-1 status depends on full-time enrollment. You need a new CPT authorization before starting another job.

Is it safe to travel on Day 1 CPT?

Travel is allowed, but you need a valid F-1 visa to return, and a consular officer may question your program. Talk to your DSO and an attorney before you book.
