How Long Does H-4 EAD Take in 2026?

Updated 2026-10-213 min readNot legal advice inWX
QUICK ANSWER

5 months, based on law firm readings of USCIS data. Filing with your H-4 extension is usually faster than filing alone. Renewals filed since October 30, 2025 get no automatic extension, so file as early as you can.

Current processing times

USCIS posts times for Form I-765 by category on its processing times site. It shows how long it took to finish 80% of recent cases. The numbers change monthly.

Manifest Law, reading USCIS data as of October 2026, reported these ranges for category (c)(26). Treat them as estimates and check the USCIS site for your service center.

  • Filed with Form I-539 (H-4 extension): about 6.5 months.
  • Filed with your spouse's H-1B extension: roughly 6 to 9 months.
  • Filed alone (standalone I-765): about 17.5 months.

Automatic extension rules as of October 2026

This is the change most H-4 families need to plan around.

Renewals filed before October 30, 2025: if you met the conditions, your card was extended for up to 540 days while the renewal is pending. You needed an unexpired H-4 I-94 and the receipt notice.

Renewals filed on or after October 30, 2025: no automatic extension. DHS published an interim rule on that date and made it final on October 14, 2026, effective the same day. Your work authorization ends when the card expires, unless USCIS approves the renewal first.

In September 2026, news reports said a federal court in California granted temporary relief to seven H-4 plaintiffs. That order covers only those plaintiffs. For everyone else, the rule applies. This is still developing.

When to file your renewal

You can file up to 180 days before your current EAD expires. With processing above six months, filing on day one of that window matters.

Your new card cannot run past your H-4 I-94. So the real limit is often your spouse's H-1B extension. Ask the employer to file the H-1B extension early, and file your I-539 and I-765 with it.

Can you get it faster?

Premium processing is not available for an H-4 EAD on Form I-765. USCIS limits I-765 premium processing to certain student categories, and I-539 premium processing to changes into F, M or J status.

Bundling still helps. If your spouse's employer files the H-1B extension with premium processing, file your I-539 and I-765 in the same package. Law firms note USCIS is no longer required to decide them together, since a court settlement that required it expired in January 2025. In practice, bundled cases often move faster.

You can ask USCIS to expedite. Criteria include severe financial loss, urgent humanitarian reasons and clear USCIS error. Approval is discretionary and not common.

Biometrics

USCIS may schedule a biometrics appointment for your I-765 so it can produce the card. Attend it or reschedule before the date. Missing it without notice can cause USCIS to treat the application as abandoned.

There is no fixed time from biometrics to approval. Check your case status online.

If your card expires first

Stop working on the expiry date and tell your employer. Ask whether they can hold the job or offer unpaid leave.

Your H-4 status itself continues as long as your I-94 is valid. You only lose the right to work. For more on the work permit itself, see the H-4 EAD hub, and our H-4 EAD application guide for the forms.

Questions

How long does a first-time H-4 EAD take in 2026?

Roughly 6.5 months when filed with an I-539, and up to about 17.5 months standalone, per October 2026 estimates. Check USCIS's site for current numbers.

Is there premium processing for H-4 EAD?

No. Premium processing is not offered for Form I-765 in category (c)(26).

Can I work on my H-4 EAD receipt notice?

Only if you filed your renewal before October 30, 2025 and met the old conditions. Renewals filed after that get no automatic extension.

How early can I file my H-4 EAD renewal?

Up to 180 days before your current card expires.

Does filing with my spouse's H-1B premium case help?

Often, yes. USCIS is not required to decide them together anymore, but bundled cases tend to move faster in practice.
