E-3 vs H-1B: Which Is Better for Australians?
For most Australians, the E-3 is faster, cheaper and more certain: no lottery, two-year renewable terms and a spouse who can work. The H-1B is mainly worth it when you plan to apply for a green card, because it allows immigrant intent and the E-3 does not.
Every job is from an employer that filed H1Bs in 2025. See which ones fit your resume.
Side by side
- Who can use it: E-3 is for Australians only. H-1B is open to any nationality.
- Lottery: E-3 has none. Most new H-1B jobs need a lottery win first.
- Cap: E-3 has 10,500 a year and has not run out. H-1B has 65,000 plus 20,000 for US master's graduates.
- Employer paperwork from abroad: E-3 needs only an LCA. H-1B needs an LCA and a USCIS petition.
- Length: E-3 is two years at a time with no fixed limit. H-1B is up to three years at a time, usually six in total.
- Spouse work: E-3 spouses are work authorized. H-4 spouses can work only with an H-4 EAD in limited cases.
- Green card: H-1B allows immigrant intent. The E-3 does not.
The lottery is the big difference
Since the FY 2027 season in March 2026, the H-1B lottery gives more entries to higher wage levels. Even so, many people are not selected. Read how the wage-based lottery works.
The E-3 has no lottery. If you have an offer that fits your degree, you can apply right away.

Cost to the employer
From abroad, an E-3 costs the employer an LCA, which has no government fee, plus any attorney fees. You pay the visa application fee.
An H-1B petition carries USCIS fees, and new petitions for workers outside the US were hit by the September 2025 $100,000 payment. As of October 2026, collection is paused by court order while the government appeals. See the $100,000 fee guide.
Your spouse's job
E-3 spouses are work authorized incident to status. That alone can tip the decision for a two-income family.
H-4 spouses need an H-4 EAD, which is tied to green card milestones like an approved I-140.
Green cards and dual intent
H-1B law lets you hold the visa while planning to immigrate. You can also travel on a valid H-1B while your I-485 is pending.
E-3 holders must show they intend to leave when their status ends. Once an I-485 is filed, traveling on the E-3 generally abandons it unless you have advance parole. Read E-3 to green card.
When switching to H-1B makes sense
Consider it when your employer is ready to start your green card and the timing looks long, or when you expect a lot of travel during the process.
Your employer registers you in the March lottery. If you are selected, it files a change of status to start October 1. USCIS has said a change of status granted inside the US is not subject to the $100,000 payment. Staying on E-3 until then costs you nothing.
If you also hold another citizenship
Dual Australian and Canadian or Mexican citizens may also qualify for TN status. Compare it in TN vs H-1B. Both TN and E-3 lack immigrant intent, so the choice usually comes down to your profession and how easily you can renew.
Not legal advice
This is general information as of October 21, 2026, not legal advice. Rules and fees change, so confirm your situation with an immigration attorney.
Questions
Is the E-3 better than the H-1B?
For getting to the US quickly, usually yes: no lottery, lower cost and spouse work rights. For a green card, the H-1B is safer because it allows immigrant intent.
Can I switch from E-3 to H-1B?
Yes. Your employer registers you in the H-1B lottery and, if you are selected, files a change of status. You can stay on E-3 while you wait.
Does the E-3 have a six-year limit like the H-1B?
No. E-3 status comes in two-year terms with no fixed maximum, as long as you keep showing temporary intent.
E-3 or TN if I qualify for both?
Both skip the lottery and lack immigrant intent. TN gives up to three years at a time but only for listed professions; E-3 covers any specialty occupation and lets your spouse work.
Would my employer pay the $100,000 fee for an E-3?
The proclamation covers new H-1B petitions, not the E-3. As of October 2026, H-1B collection is also paused by court order.
