H-4 EAD vs H-1B: Which Is Better for You?

Updated 2026-10-212 min readNot legal advice inWX
QUICK ANSWER

H-4 EAD gives you more job freedom: any employer, any job, part-time or self-employment. H-1B gives you more stability: your own status that does not depend on your spouse. Which is better depends on your spouse's case, your field and how much a renewal gap would hurt.

Find jobs you can take on H-4 EAD

Every job is from an employer that filed H1Bs in 2025. See which ones fit your resume.

Side-by-side

  • Who controls it: H-4 EAD depends on your spouse's H-1B and I-140. H-1B is yours, tied to your employer.
  • Jobs allowed: H-4 EAD allows almost any job. H-1B allows only the specialty occupation job your employer petitioned for.
  • Getting it: H-4 EAD needs a Form I-765. H-1B usually needs a lottery win and an employer petition.
  • Cost to employers: H-4 EAD costs them nothing extra. H-1B costs filing fees and legal work.
  • Renewals: H-4 EAD renewals filed since October 30, 2025 get no automatic extension. H-1B extensions filed on time let you keep working for the same employer while pending.
  • Changing jobs: H-4 EAD lets you change any time. H-1B needs a new petition, though you can start once it is filed.

When H-4 EAD makes more sense

  • Your spouse has an approved I-140 and a stable job.
  • You want part-time, freelance or non-degree work, or to run a business.
  • You are early in a career change and want flexibility.
  • Your spouse's green card is close, so your EAD will soon be replaced.

When your own H-1B makes more sense

  • Your spouse works at an employer with shaky green card plans. As of October 2026, PERM filings are frozen for eight employers, including Microsoft and Infosys. See the PERM freeze guide.
  • A long gap from an EAD renewal would cost you a job you want to keep.
  • You want to start your own green card case, which can protect the family if one case stalls.
  • Your field has steady sponsorship, like software, data or engineering.

The renewal gap problem

This is the biggest change for 2026. H-4 EAD processing runs from about 6.5 to 17.5 months, by law firm estimates. Without automatic extensions, many H-4 workers face a stretch with no work permit.

H-1B workers do not face that same gap when the same employer files an extension on time. See H-4 EAD processing time for the current picture.

Costs and the lottery

An H-1B usually requires the March lottery. For FY 2027, selection was weighted toward higher wage levels, which affects lower-paid roles.

If you are in the US and USCIS grants a change of status, the $100,000 proclamation payment does not apply, per USCIS guidance. Our H-4 to H-1B guide walks through the steps.

Family effects

If you switch to H-1B, your children can stay on H-4 under either parent. Your spouse keeps their own H-1B.

Two H-1B workers in one family means two green card cases. Whichever reaches a green card first can include the spouse and children.

You can look for sponsors in your field on H1B jobs by role.

Questions

Should I stay on H-4 EAD or get my own H-1B?

Stay on H-4 EAD if your spouse's I-140 is approved and you value flexibility. Get your own H-1B if a renewal gap or your spouse's employer is a risk.

Can I go back to H-4 after getting H-1B?

Yes, you can later file to change back to H-4 if your spouse is still in H-1B status. Your H-4 EAD would need a new application.

Is H-1B more secure than H-4 EAD?

Usually, because it does not depend on your spouse. It does depend on your employer.

Can both spouses be on H-1B?

Yes. Each needs their own employer petition, and children can be H-4 under either parent.

Does the PERM freeze affect H-4 EAD?

It can. If your spouse's employer cannot file PERM, your spouse may never get the I-140 that makes you eligible.
