Can E-3 Visa Holders Get a Green Card?

Updated 2026-10-212 min readNot legal advice inWX
QUICK ANSWER

Yes. E-3 holders get green cards the same way most workers do, usually through PERM labor certification, an I-140 petition and then an I-485 or consular visa. The catch is that the E-3 does not allow immigrant intent, so you need to plan visa renewals and travel around each step.

The usual path

Your employer runs PERM with the Labor Department, then files Form I-140 with USCIS. When a visa number is available for you, you file Form I-485 in the US or go through consular processing abroad.

Our H-1B to green card guide explains each step in detail. The steps are the same for E-3 holders. To find employers that file PERM, see green card sponsors.

Why dual intent matters

US law presumes every visa applicant intends to immigrate, with exceptions for H-1 and L workers. The E-3 is not one of them.

That means each time you renew your E-3 or enter the US, you need to show you plan to leave when your status ends. A green card process can make that harder to show.

Which steps carry risk

Law firms generally see PERM, which is the employer's filing, as lower risk. Views differ on how much an approved I-140 matters at a consular interview.

Most agree the riskiest moments are renewing your E-3 visa abroad after a green card filing, and filing the I-485 itself. A consular officer decides intent case by case.

Travel after you file the I-485

Under 8 CFR 245.2, leaving the US while an I-485 is pending generally abandons it. H-1 and L-1 workers have an exception. E-3 holders do not.

So once you file, do not travel on your E-3 visa. Apply for advance parole, Form I-131, and wait for it before any trip. You can also file for a work permit, Form I-765, with the I-485.

Timing that helps

  • Renew your E-3 visa stamp before the employer files anything, if a renewal is coming up.
  • Extend inside the US with USCIS instead of at a consulate while the case is moving.
  • Keep travel light between the I-140 and the I-485.
  • File the I-485 as soon as your date is current, then stop E-3 travel.
  • If the wait looks long, consider switching to H-1B first. See E-3 vs H-1B.

How long it takes for Australians

Green card lines go by country of birth, not citizenship. Most Australian-born applicants fall under rest of world, which is usually shorter than India or China.

Even so, EB-2 and EB-3 dates move. Check the State Department visa bulletin each month for your category.

Before you start

Check that your employer files PERM at all. On October 8, 2026, the Labor Department froze PERM filings for eight large employers. See the PERM freeze.

Other routes skip PERM, such as EB-1, a national interest waiver or marriage to a US citizen. Each has its own intent and timing questions.

Questions

Can E-3 holders apply for a green card?

Yes. Most do it through employer sponsorship with PERM, an I-140 and an I-485. The E-3 lacks immigrant intent, so timing and travel need care.

Is the E-3 a dual intent visa?

No. The law exempts H-1 and L workers from the immigrant intent presumption, but not E-3 workers.

Can I travel on my E-3 while my I-485 is pending?

Generally no. Leaving abandons the I-485 unless you have advance parole. The H-1 and L-1 travel exception does not cover the E-3.

Can I renew my E-3 after my employer files PERM?

Many people do, but it carries some risk because the consular officer must still be satisfied that you intend to leave. Renewing before the filing, or extending with USCIS, lowers that risk.

Should I switch to H-1B before a green card?

It can help if you expect a long wait or frequent travel. It needs a lottery win, so start early.
