Can You Get a Green Card From TN Status?
Yes. Many TN holders get green cards through employer sponsorship, using PERM, an I-140 and an I-485. The risk is that TN requires temporary intent, so border entries and renewals during the process need careful timing.
Every job is from an employer that filed H1Bs in 2025. See which ones fit your resume.
Can a TN holder take a permanent job?
The job itself can be open-ended. What matters is your intent: TN rules require a stay with a reasonable, finite end that does not equal permanent residence.
USCIS also notes a management consultant may be admitted temporarily to fill an otherwise permanent position. Officers look at your plans, not just the job.
The usual path
Your employer files PERM with the Labor Department, then an I-140 with USCIS. When your priority date is current, you file an I-485 in the US or go through consular processing.
The steps are the same as for H-1B workers. See H-1B to green card and find employers that file PERM in green card sponsors.

Where the risk is
Law firms generally see PERM as the employer's filing and lower risk. They disagree on the I-140: some say an approved I-140 is not by itself proof of immigrant intent, others warn it can complicate a TN renewal.
Most agree the riskiest points are a TN renewal or border entry after filings are made, and the I-485 filing itself.
A CBP officer judges your intent each time you enter. That is why people who cross the border often feel this risk most.
Travel after the I-485
Federal rules say leaving the US while an I-485 is pending generally abandons it. H-1 and L-1 workers have an exception. TN workers do not.
After you file, get advance parole before any trip, including a quick drive across the border.
Timing that helps
- Renew or extend your TN before the employer files anything, if you can.
- Prefer a USCIS extension over a border renewal while the case is moving.
- Avoid border crossings between key filings.
- File the I-485 as soon as your date is current.
- If the wait is long, consider switching to H-1B first. See TN vs H-1B.
Waiting for a visa number
Green card lines depend on your country of birth, not your citizenship. A Canadian citizen born in India waits in the India line.
If your TN runs out before you can file an I-485, you could lose work authorization. Plan the TN expiry date against the visa bulletin.
Check your employer first
Not every TN employer sponsors green cards. On October 8, 2026, the Labor Department also froze PERM filings for eight large employers. See the PERM freeze.
Some routes skip PERM, such as EB-1, a national interest waiver or marriage to a US citizen. Each still raises timing and travel questions, so map them out with an attorney before anything is filed.
Not legal advice
This is general information as of October 21, 2026, not legal advice. Rules and fees change, so confirm your situation with an immigration attorney.
Questions
Can I get a green card from TN?
Yes, usually through PERM, an I-140 and an I-485. TN lacks dual intent, so plan renewals and travel around each step.
Does filing PERM end my TN?
No. PERM is the employer's filing, and law firms generally see it as lower risk, though each border officer judges your intent.
Can I renew TN after my I-140 is approved?
Many people do, but some officers may question your intent. Renewing before filings, or extending through USCIS, lowers the risk.
Can I travel to Canada while my I-485 is pending?
Not on TN. Leaving generally abandons the I-485 unless you have advance parole.
Should I switch to H-1B before a green card?
It removes the intent problem but needs a lottery win. Many TN holders enter the lottery early in the process.
